Agreement for Mountain Lake Dam
This page is a brief summary of the utility license agreement between:
Washington State Parks and Recreation Commission and the licensees:
Olga Water Users Inc. (OWU)
Doe Bay Water Users Association (DBWUA)
The license agreement was issued in Dec 1990 with an automatic renewal
clause after 40 years.
The water stored above the dam in Mountain Lake is very precious.

water levels in Mountain Lake (1992 - 1995)
Highlights of the License Agreement:
- The agreement does interfere with or enhance any water rights.
Rosario, the
owner of the most senior rights chose not to participate in the
agreement. However their senior water rights are acknowledged,
and are not affected.
- The dam and stop logs are the sole property of the State of
Washington.
- The valves to Doe Bay and Cascade Creek are owned and operated by
DBWUA and OWU respectively.
- The long term management, operation and maintenance of the dam
and valves is specified in detail.
- The State Parks personnel will place the stop logs according to
the schedule to raise the level of the lake 16" above the spillway
(922.37' ASL) by the first of June each year. The licensee fee payments
are subject to the proper level being achieved on time.
- OWU also owns and maintains a separate 4' dam and valves further
down
stream
- The state will maintain a water level gauge at the dam and
provide
monitoring records to OWU and DBWUA
- Easements for pipelines and access are described. There must be
written permission from the Parks commission to cut any trees, etc.
The actual legal descriptions stretch the above list into 45 pages that
have been recorded with the county.
Moran State Park also has the "Mountain Lake Dam Operation and
Maintenance Manual",
which was developed in cooperation with OWU and DBWUA. The manual
includes extensive
details on cleaning, maintenance and safety inspections.
